TEXAS BECOMES FIRST STATE TO REQUIRE WARRANTS FOR EMAIL SEARCHES

Texas Governor Rick Perry has signed a bill the requires local and state and law enforcement to obtain a warrant before accessing emails. Last Friday the governor signed HB 2268 officially making Texas the first state with such a requirement. Under previous law, namely the Electronic Communications Privacy Act (ECPA), federal law enforcement agencies were only required to get a warrant to access recent e-mails before they are opened by the recipient. Once an email has been read or left unopened in the inbox for more than 180 days no warrant was required. With the Governor’s signature all that has come to an end.
