Harris County can now impose mask mandates, a state appeals court rules
A Texas appeals court on Thursday ruled that Harris County can impose mask mandates, blocking enforcement of Gov. Greg Abbott’s ban on such policies.
The Texas Third District Court of Appeals upheld a previous lower court ruling, saying that Abbott exceeded his authority in barring local governments from adopting mask mandates to slow the spread of COVID-19. Harris County Attorney Christian Menefee hailed the decision as a victory.
“We have a clear set of laws in this state,” Menefee said. “We have a clear constitution, and the governor has to act within those in responding to this pandemic. And it’s important that local officials be empowered to take the steps necessary to keep people safe during the pandemic.”

Religious Objection to COVID Vaccine: Federal Judge Temporarily Blocks Navy Mandate | National Review
A federal judge issued a preliminary injunction on Monday blocking the Department of Defense from taking action against 35 Navy service members who refused a Covid vaccine because of religious objections.Judge Reed O’Connor of the Northern District of Texas issued the injunction after service members from the Navy SEALS and Naval Special Warfare Command sued the Biden administration over the military vaccine mandate.The Navy servicemembers in this case seek to vindicate the very freedoms they have sacrificed so much to protect,” O’Connor wrote in his 26-page injunction. “The COVID-19 pandemic provides the government no license to abrogate those freedoms. There is no COVID-19 exception to the First Amendment. There is no military exclusion from our Constitution.” O’Connor added that while he “does not make light of COVID-19′s impact on the military,” the “loss of religious liberties outweighs any forthcoming harm to the Navy.”
Attorneys spar over United Airlines vaccine mandate at Fifth Circuit
An attorney representing United Airline employees who sued the company over its Covid-19 vaccine mandate told a Fifth Circuit panel Monday evening that getting the shots would make them “complicit in the destruction of human life” because the three vaccines available in the U.S. were developed using stem cell technology.
Some of the workers have previously claimed in court documents they could not get the vaccinate for various other reasons, including having severe reactions to allergens, including eggs and penicillin, while another plaintiff said he suffered from multiple sclerosis.
Attorney Gene Schaerr argued on behalf of the United employees Monday night and said the key issue in the case is that the airline is using coercion to force its employees to get vaccinated, arguing that doing so would cause them irreparable harm both because of the crisis of consciousness over doing something they are opposed to and because it cannot be undone.
“What’s key here is a sustained effort at coercion” from United Airlines, Schaerr told the three-judge panel.
Six employees based at Dallas-Fort Worth International Airport filed a federal class action against United in September, saying it forced employees who refused vaccines for medical or religious reasons to take unpaid leave, in violation of their rights under the Americans with Disabilities Act and Title VII of the Civil Rights Act. The plaintiffs are awaiting permission from the Equal Employment Opportunity Commission to pursue their Title VII claims.
